Delhi High court allows well-known trademark protection without prior formal declaration

The Delhi High Court has ruled that a formal declaration under Rule 124 is not mandatory to invoke Section 11(2) of the Trade Marks Act, 1999, which protects well-known trademarks from similar marks even for unrelated goods or services. Proprietors may establish well-known status through evidence in individual proceedings.
