Formal court application unnecessary to invoke Central Drugs Laboratory re-testing safeguard

The High Court of Jammu and Kashmir and Ladakh held that accused drug manufacturers are not required to make a formal request before a Magistrate to invoke sample re-analysis safeguards under the Drugs and Cosmetics Act, 1940. Written notification to the drug inspector controverting the analyst report within 28 days sufficiently obligates authorities to send samples to the Central Drugs Laboratory.
