Medical devices cannot be prosecuted as drugs without statutory Gazette notification

The Punjab and Haryana High Court has held that an administrative clarification bringing a device under ambit of a notified medical device is not tenable in law. The judgment raises a broader regulatory concern around products that remain outside statutory notification, including spectacles and toothbrushes, despite being regulated as medical devices in other jurisdictions, and the role of administrative convenience in such exclusions.
