Import restrictions cannot apply to goods shipped before notification: Bombay High Court

The Bombay High Court has held that import restrictions under the Foreign Trade Policy must be assessed with reference to the shipment date, rather than customs clearance or bill-of-entry filing dates. The ruling protects importers from subsequent policy changes affecting goods already dispatched, ensuring that newly notified restrictions are not applied retrospectively to consignments shipped before publication.
