Maharashtra FDA challenges FSSAI’s licensing and enforcement powers before Bombay High Court

The Government of Maharashtra, through its Food Safety Commissioner, has approached the Bombay High Court, alleging that the Central Government and FSSAI created a parallel enforcement regime that encroaches upon State powers. The petition specifically contests the May 2023 circular barring State FDA officers from inspecting or taking enforcement action against establishments holding Central licenses. It argues that the restriction curtails State oversight of major food businesses and seeks a stay on the circular and restoration of inspection and enforcement authority.
