Choice of a recognised medical procedure alone cannot establish negligence

The Bombay High Court has quashed an order removing two doctors from the medical register after finding that the choice of one recognised surgical procedure over another could not, by itself, establish medical negligence. The Court relied on Supreme Court precedent that a doctor acting with reasonable skill and competence cannot be held negligent merely because another treatment option may have been preferred. The ruling reinforces that professional disagreement over treatment choice does not, by itself, justify disciplinary action where the chosen procedure was recognised and performed with reasonable competence.
