Menstrual health upheld as a fundamental right under Article 21

The Supreme Court has warned States of possible contempt proceedings for failing to implement its directions on menstrual hygiene in schools. The Court has recognised menstrual health as a fundamental right under Article 21 and has sought accountability from States for delays in implementing the required measures.

The directions require access to free sanitary napkins, functional toilets, washing facilities and menstrual hygiene management corners in schools. The proceedings highlight the need for authorities responsible for school infrastructure and education services to ensure these requirements are implemented.
